Understanding Non-Disclosure States in Real Estate

In most U.S. states, real estate sales are part of public record. But in some states, that's not the case. These are known as non-disclosure states—and they operate under a different set of rules.

What Is a Non-Disclosure State?

In non-disclosure states, the sale price of a property isn’t publicly recorded. That means you won’t find this data in government records, tax assessor websites, or most public-facing real estate platforms.

Instead, sale price information is typically limited to:

• Licensed real estate agents via MLS access

• Certified appraisers using private valuation tools

• Industry platforms built for market analysis

This can make pricing insights more difficult to access for buyers, sellers, and third-party platforms.

List of Current Non-Disclosure States

As of now, the following 12 states do not require public disclosure of property sale prices:

• Alaska (AK)

• Idaho (ID)

• Kansas (KS)

• Louisiana (LA)

• Mississippi (MS)

• Missouri (MO)

• Montana (MT)

• New Mexico (NM)

• North Dakota (ND)

• Texas (TX)

• Utah (UT)

• Wyoming (WY)

Why It Matters
